Copyright policy
1. General provisions
OWN RAEY marketplace is designated for and acts as an online platform, where the Seller(s) can offer their digital items to the Buyer(s) and the Buyer(s) can purchase thereof, directly between the Seller and the Buyer. Despite OWN RAEY adheres to the list of Prohibited/Restricted Items and Activities on its online marketplace, which should be strictly observed by the Users, OWN RAEY is not and cannot be responsible for the content provided by the Users, including content with protected copyright.
2. Intellectual property
By accessing OWN RAEY website user acknowledges that all content of the website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of OWN RAEY (as per the website infrastructure and marketplace provision) or OWN RAEY content suppliers (e.g., as per the Seller(s)’s posts, etc.) protected by international copyright laws.
It is hereby clarified that User neither has nor will have the right to copy, to modify, to disassemble, to hack nor to duplicate website content, of any kind whatsoever, in any matter whatsoever that relates to the Company intellectual property rights, directly or indirectly, including without limitation any modifications, enhancements or derivatives thereof and/or even extra developments.
OWN RAEY grants the User a revocable, non-exclusive, non-transferable license to use OWN RAEY software as a marketplace platform, including all updates, upgrades, new versions.
Any users intellectual property including but not limited to logos, graphics, images, digital downloads and software shall remain at all times, wholly and exclusively vested in the user.
The User hereby grants OWN RAEY an irrevocable, non-exclusive, royalty–free, sub–licensable (through multiple tiers), perpetual, worldwide license for OWN RAEY to post, place, list the User’s information and content on this website, allowing OWN RAEY to display this information and content in accordance with OWN RAEY format. Thereat, OWN RAEY does not claim any ownership rights in the User’s information and content (including, but not limited to, images, trademarks, trade names, logos, etc.). Therefore, the User grants OWN RAEY a license only to allow OWN RAEY marketplace platform use it as a trade venue between Users, without violating any rights in that information and content.
3. Content posting rules
By posting any content on the OWN RAEY website user confirms that they are the owner of the content they post and undertake not to post any copyrighted content unless they have a proper authorization from the copyrighted content owner. It is user’s obligation to ensure that provided content is free from any third-party claims and that such content does not infringe any intellectual property rights of any third party.
OWN RAEY reserves the right to remove any content from it’s website in case there is a high level of probability that such content may infringe intellectual property rights of the third party. OWN RAEY also reserves the right to terminate any agreements/accounts with the seller engaged into posting third party infringing content without any prior notice.
4. Limitation of liability
In no event shall OWN RAEY be responsible for any direct/indirect damages caused by unauthorized copyrighted content placement on the website by the user. Any responsibility that derives from such infringement is to the fullest extent liability of user.
5. Compensation
User understands that posting any unauthorized copyrighted content on OWN RAEY website may cause significant material and reputational damage to the Company. In case OWN RAEY has suffered such damages it may seek any effective legal remedy against the user in order to restore it’s material and reputational damage.
